DPDP Act 2023 and AI Agents: The Compliance Landscape
The Digital Personal Data Protection Act 2023 — India's first comprehensive data protection legislation — came into force with significance that many enterprise leaders initially underestimated. For organisations deploying AI agents, the DPDP Act creates specific, non-trivial compliance obligations that determine which AI deployment architectures are viable and which expose the organisation to regulatory risk.
The core question: when your AI agent processes personal data in the course of its work — reading employee records, accessing customer information, handling HR queries, processing financial data — does that processing comply with DPDP? The answer depends entirely on where AI inference happens and what safeguards are in place.
What DPDP Requires for AI Data Processing
The DPDP Act 2023 establishes several obligations that directly affect AI agent deployments:
Purpose limitation. Personal data may only be processed for the specific, lawful purpose for which consent was obtained. An AI agent that processes employee HR data must be configured to process only what is necessary for its defined function.

Data localisation. While DPDP does not have blanket data localisation requirements, BFSI, healthcare, and government sectors operate under effective data localisation constraints through sector-specific regulations (RBI IT outsourcing guidelines, IRDAI regulations).
Breach notification. Organisations must notify the Data Protection Board within 72 hours of a personal data breach. An AI agent that inadvertently exposes personal data creates breach notification obligations.
